Rape is very hard to prove. Most people can be easily persuaded that it was consensual unless a) the coroner tells them the post-mortem showed sexual assault, or b) the victim is under-aged. And these days of a culture that sexualizes children, even b) is a hard sell. The states that are poised to outlaw abortion, or that never repeal those laws and they will go back into effect immediately when the SC overturns Roe, has voters who really believe all the fantasies we've heard over the last 50 years: if it's really rape, the woman won't get pregnant. But never mind. Gov. Abbott (T-TX) has promised he will eliminate rape. I.e., define it out of existence, is my guess.
As for incest, all the same arguments as above. Underage girls are often even described as "women" or "young women" in the media accounts of the event.
