Associate Justice Stephen Breyer is retiring
Now imagine a Supreme Court that looks like America
News spread Wednesday that Associate Justice Stephen Breyer, who at 83 is known as a “moderate” liberal whose decisions are sometimes difficult to predict, would step down from the Supreme Court.
For a while now, some Democrats have been pushing for Justice Breyer’s resignation in order to give Pres. Biden the opportunity to name a less-moderate liberal (that’s my hope, anyway) to balance out a heavily conservative court, after the bench was packed by the other guy, who also named more than his share of federal judges. The courts are lousy with the stench of the other guy, and this might be a way of airing things out. The new nominee won’t change the 6-3 conservative-progressive count, but isn’t it ADT (About Damn Time) to have a woman of color on the bench? Biden has said — from the campaign trail on — that he would nominate a Black woman, and hell, yeah, it’s time. From Investopedia:
Breyer is a Clinton appointee who replaced the towering jurist Harry Blackmun, who as a conservative, wrote the majority opinion for Roe v. Wade.
I’m really hoping Pres. Biden asks me to join the Court (did you know you don’t have to be a lawyer to be an Associate Justice?) but barring that, I see several people on this list who would add greatly to the discussion. Then again, any one from this group would be wonderful.
I want the youngest woman, someone who will be on the Court for 40 or 50 years and outlive all those S.O.B.s, especially Thomas, Kavanaugh (he'll drink himself to death), Gorsuch, and Barrett. Of these two lists, I like Leondra Kruger. She's young, attractive, a Californian, and the Faux outrage will be long and loud, especially from Hannity.
Here's hoping that Senators Manchin and Sinema don't think it's overly factionalism to vote with Dems.
A Demand Progress spokesperson speaking on NPR this morning said that he thinks there may be some GOP votes to support a nomination, though.
